Harbor Shoppers Services and Responsibility
Harbor Shoppers provides a clean, secure online e-commerce store www.harborshoppers.com in which marine products are displayed for sale or auction as consignment. Harbor Shoppers takes pride in a well-trained, informed and customer service oriented staff which makes every effort to make the customer’s shopping/auction experience a positive and rewarding one. Harbor Shoppers will provide display space and advertising & marketing services using various venues and social media. The website will run 24 hours per day/7 days per week. Some products maybe dropped off to our retail locations and the same terms will apply unless both parties agree to change the terms.
Account Activity, Payouts, Fees
Vessels:
Vessels can be defined as any motorized or non motorized watercraft that can be registered in a country as a mode of transportation; examples include but are not limited to, sailboat, jetski/waverunner, canoe, fishing boat, power boat, houseboat etc.
Consignor will provide vessel(s) that are owned and free and clear of title to Harbor Shoppers. If there is a lien, all information pertaining to the lien must be made available to Harbor Shoppers prior to the listing of the vessel. Proof of ownership or legal documentation proving the right to sell the vessel will be required prior to listing. Harbor Shoppers reserves the right to refuse vessels that do not meet acceptable conditions for consignment at the sole discretion of Harbor Shoppers. Harbor Shoppers offers a pick-up and storage service of vessels for an additional fee(s). Fees are set individually per vessel based on location, accessibility, size, weight, etc. The sales rep with Harbor Shoppers will need access to the vessel, pictures and/or videos of the vessel. It is strictly against Harbor Shoppers policy for a consignor to omit or not properly disclose damages on a listing. Consignors that do not properly list a vessel or do not properly disclose damages when listing and selling the vessel could lose future privileges to consign on Harbor Shoppers and are responsible for any legal fees that may be associated with the transaction. Failure to properly list a vessel may affect the outcome of the sale and may result in a refund of proceeds to the buyer.

Pricing:
Harbor Shoppers will retain/charge a commission of 10% of the purchase/sales price for the sale and/or auction of the vessel posted through Harbor Shoppers, in addition, a buyer’s premium of 3% is charged to the buyer; vessels under $2000 there is a 20% to Harbor Shoppers & 80% to consignor unless otherwise agreed upon in writing by Harbor Shoppers and consignor. Harbor Shoppers will collect the commission and buyer’s premium (13%) during the sales checkout from the buyer for vessel purchases for any other consignment they will collect the full balance. This fee does not include any other fees associated with the agreement. Any fees or legal costs associated with the vessel(s) sold by Harbor Shoppers for the Consignor that are not the property of the Consignor and must be returned to the actual owner OR any other legal dispute pertaining to the sale will be the responsibility of the Consignor. Wiring fees, merchant fees, and storage fees are all additional expenses. Payouts:
Consignor will be paid out on their portion of the sale of the vessel once the Buyer has received the cleared title, storage fee(s) and any and all other fees have been settled. The consignor is responsible for any and all fees associated with storage of the vessel up to and including the 9th day after closing. Buyer assumes all costs associated with storage of the vessel starting at the 10th day after the closing of the auction and any and all additional days thereafter. Harbor Shoppers will not be responsible for any storage fees at any time. For wire payments, the Consignor will be responsible for the wiring fee. Consignor will be responsible to provide a proper and legally notarized Bill of Sale for the country/port of registry of the vessel and delivered via email to:

Products (non-vessel)
Pricing:
Products are defined as any non-vessel item. All consigned products will be priced by Harbor Shoppers or the consignor when requesting a listing. Numerous factors will affect the assigned price including quality, condition, age, demand, etc. Consignors are encouraged to provide detailed information to the Harbor Shoppers staff when consigning the items that may be helpful in the determination of proper pricing of the item. Pricing is item specific, so there is no standard policy regarding pricing – especially in the case of rare, unique and high-quality items. As a general rule, consigned items are priced at about 50% to 70% of their original retail value.
When a product(s)/ is sold, the sales price is shared between Harbor Shoppers and Consignor as follows: 30% to Harbor Shoppers and 70% to the Consignor if the product resides out of the store at Consignor’s location and sold on our website.
For products that Harbor Shoppers stores on location at our stores not online and the consignor and/or sells or auctions on its site at the same time, 50% to Harbor Shoppers and 50% to the Consignor if product resides in the Harbor Shoppers facility/store only. (Note: these percentages may change in unique situations when agreed upon in writing between Harbor Shoppers and the Consignor). If auction or sale has commenced with active bidders or buyers, the consigned item cannot be returned to the Consignor. Any fees or legal costs associated with claims regarding the product and/or previous owners of the product, towards the sale of the product sold by Harbor Shoppers or claims made against Harbor Shoppers will be the responsibility of the Consignor. Any legal claims against Harbor Shoppers in regards to the contract will be the reasonability of the Consignor.
In-store Products Only: (Markdowns and Disposition of Unsold Items) (This does not apply for online sales only)
The price assigned to an item is set for 30 days, after which the price is discounted as follows: 30-39 days = 25%; 40-49 days = 50%; 50-59 days = 75%; after 90 days the item is typically removed from the sales floor/online auction as unsalable. At this point, the item becomes the property of Harbor Shoppers and the disposition of the item is SOLELY at the discretion of Harbor Shoppers – although MOST unsold items are donated to local charities. If a Consignor wishes to have an unsold item returned to them, it is SOLELY THE RESPONSIBILITY OF THE CONSIGNOR to track the dates and come to the store to retrieve the item they wish to have returned on or before the 60th date of consignment. Harbor Shoppers will not call Consignors to advise of approaching expiration dates due to the volume of merchandise inventoried and sold through the store. Items that are shipped once sold will be the responsibility of the Buyer. Any returned item(s) costs will be the responsibility of the Buyer and deducted from the Buyers account/stored method of payment and will not be Harbor Shoppers expense. Products remain the property of Consignors until it is sold or upon reaching the sales expiration date and terms listed above.
Payouts:
Any consignments that were given to an individual store on location only sales will be paid out by that location via check, store credit. Harbor Shoppers Corporate will payout all online sales.
Consignors may request a payout of the balance of their account at any time. Payouts are ONLY processed on the 1st and 15th of every month. Payment fees will be the consignor’s reasonability. Items will be paid out once the buyer has received the item and the consignor requests a payout. All Consignor account activity is easily available by contacting info@harborshoppers.com – email requesting “consignee accounts receivable”. Payouts will be paid by the consignors requested option on the following page. Instead of a payout, Consignors often accumulate the proceeds from the sale of their items to be used as a store credit. When a Consignor uses their proceeds to purchase, they receive a discount of 5% off the price of the item they purchase (Not for Vessels). After 1 year without consignment activity, all payments that are owed to the consignor will be converted into store credit.
Upon execution of this agreement, all auction products listed by Consignor are sold exclusively with Harbor Shoppers for the duration of this agreement. Termination of agreement can be made 14 days after a listing has expired and must be done in writing by Consignor and agreed upon by Harbor Shoppers. No extra charges are incurred to the Consignor from Harbor Shoppers unless consignor requests a Harbor Shoppers representative to travel to the product location. If travel is required, Consignor will be required to pre-pay for fees and expenses associated with travel before travel commences. Pricing for this will be provided in writing from Harbor Shoppers and the consignor will pre-approve the expenses. Harbor Shoppers will require a copy of your government issued ID if not registered on our site when consigning products.
When payment is received by Harbor Shoppers from the Buyer, Harbor Shoppers will provide payment to Consignor based on the payment terms and assist with the transfer of title to the new buyer if applicable. For wire payments, the Consignor will be responsible for the wiring fee. Consignor will be responsible to provide a proper and legally notarized Bill of Sale for the country/port of registry of the vessel and delivered to:

Any fees associated with products sold by Harbor Shoppers for the Consignor that are not the property of the Consignor and must be returned will be the responsibility of the Consignor. When an item or vessel is sold, the above policies will govern the relationship between Harbor Shoppers and ALL Consignors.
